Electronic Funds Transfer Agreement & Disclosures

This Disclosure is made in compliance with federal law regulating electronic funds transfer (EFT) services. Electronic funds transfers are electronically initiated transfers of money through direct deposits, automated teller machines, audio response transactions, debit card purchases or online banking involving your deposit accounts at the Credit Union or electronic funds transfers initiated by Third Parties. The following disclosures set forth your and our rights and responsibilities concerning the electronic funds transfers. In this Agreement, the words "you" and "your" mean those who sign as applicants or any authorized user(s). The words "we", "us", and "our" mean the Credit Union.

Funds Availability Policy

This disclosure describes your ability to withdraw funds at Powerco Federal Credit Union. It only applies to the availability of funds in transaction accounts. The Credit Union reserves the right to delay the availability of funds deposited to accounts that are not transaction accounts for periods longer than those disclosed in this policy. Please ask us if you have a question about which accounts are affected by this policy.

1. General Policy
Our policy is to make funds from your cash and check deposits available to you on the same business day that we receive your deposit. Electronic            direct deposits will be available on the day we receive the deposit. Once they are available, you can withdraw the funds in cash and we will use the funds to pay checks that you have written. For determining the availability of your deposits, every day is a business day, except Saturdays,  Sundays, and federal holidays. If you make a deposit before 4:00 p.m. on a business day that we are open, we will consider that day to be the day of your deposit. However, if you make a deposit after our cutoff hour or on a day we are not open, we will consider that the deposit was made on the next business day we are open.

2. Reservation of Right to Hold
In some cases, we will not make all of the funds that you deposit by check available to you on the same business day that we receive your deposit. Funds may not be available until the second business day after the day of your deposit. However, the first $200.00 of your deposit will be available on the same business day of your deposit. If we are not going to make all of the funds from your deposit available on the same business day, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees or if we decide to take this action after you have left the premises, we will mail you the notice by the next business day after we receive your deposit. If you will need the funds from a deposit right away, you should ask us when the funds will be available.

3. Holds On Other Funds 
If we cash a check for you that is drawn on another financial institution, we may withhold the availability of a corresponding amount of funds that are already in your account. Those funds will be available at the time funds from the check we cashed would have been available if you had deposited it. If we accept for deposit a check that is drawn on another financial institution, we may make funds from the deposit available for withdrawal immediately but delay your availability to withdraw a corresponding amount of funds that you have on deposit in another account with us. The funds in the other account would then not be available for withdrawal until the time periods that are described elsewhere in this Disclosure for the type of check that you deposited.

4. Longer Delays May Apply
We may delay your ability to withdraw funds deposited by check into your account an additional number of days for these reasons:

  • We believe a check you deposit will not be paid.
  • You deposit checks totaling more than $5,000.00 on any one (1) day.
  • You redeposit a check that has been returned unpaid.
  • You have overdrawn your account repeatedly in the last six (6) months.
  • There is an emergency, such as failure of communications or computer equipment.

We will notify you if we delay your ability to withdraw funds for any of these reasons and we will tell you when the funds will be available. They will generally be available no later than the seventh business day after the day of your deposit.

5. Special Rules For New Accounts
If you are a new member, the following special rules will apply during the first 30 days your account is open.

Funds from electronic direct deposits to your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers, and the first $5,000.00 of a day’s total deposits of cashier’s, certified, teller’s, traveler’s, and federal, state, and local government checks will be available on the next business day after the day of your deposit if the deposit meets certain conditions. For example, the checks must be payable to you. The excess over $5,000.00 will be available on the ninth business day after the day of your deposit. If your deposit of these checks (other than a U.S. Treasury check) is not made in person to one of our employees, the first $5,000.00 will not be

available until the second business day after the day of your deposit. Funds from all other check deposits will be available on the ninth business day after the day of your deposit.


Military Lending Act Notice

Federal law provides important protections to members of the Armed Forces and their dependents relating to extensions of consumer credit. In general, the cost of consumer credit to a member of the Armed Forces and his or her dependent may not exceed an annual percentage rate of 36 percent. This rate must include, as applicable to the credit transaction or account: The costs associated with credit insurance premiums; fees for ancillary products sold in connection with the credit transaction; any application fee charged (other than certain application fees for specified credit transactions or accounts); and any participation fee charged (other than certain participation fees for a credit card account.

Unlawful Internat Gambling Enforcement Act Notice

The Unlawful Internet Gambling Enforcement Act (UIGEA) of 2006 (effective June 1, 2010) implemented regulations which prohibit commercial/business members from receiving deposit or other credits of any kind relating to their operation of an illegal internet gambling business. Unlawful internet gambling means to place, receive, or otherwise knowingly transmit a bet or wager by any means which involves the use, at least in part, of the internet where such bet or wager is unlawful under any applicable federal or state law in the state or tribal lands in which the bet or wager is initiated, received, or otherwise made.

Unlawful internet gambling transactions are prohibited from being processed through your accounts and your relationship with the credit union. This includes transactions involving payments made through credit cards, debit cards, ATM cards, reloadable cards, electronic funds transfers or ACH, wire transfers, checks and bill payments. Powerco Federal Credit Union is required to enforce that prohibition.

It is Powerco Federal Credit Union’s policy to not open or maintain any account for commercial/business members held with the intent to conduct or engage in internet gambling activity, whether legal or illegal. If the credit union discovers or determines that an existing commercial/business member transacts or engages in internet gambling activity as defined by the UIGEA, the credit union reserves the right to restrict services or terminate the account relationship. At this time, Powerco Federal Credit Union does not open commercial/business accounts.

USA Patriot Act

Important information concerning procedures for opening a new account.

To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account.

What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.


To help the government fight the funding of terrorism and money laundering activities, Federal law (Section 326) requires all financial institutions to obtain, verify and record information that identifies each person who opens an account. We will ask for your name, address, date of birth and other information that will allow us to identify you and all listed on your account. A photocopy of picture identification for yourself and any other persons who will be listed on your account may be obtained. Acceptable forms of picture identification include your state issued driver’s license, military identification card, state identification card, etc. 


If you are an existing member who joined the credit union before the USA Patriot Act rules became effective, October 26, 2001, we may also need to verify and retain copies of any documents used to verify your identity when you request a new deposit account, apply for a loan or are added as a signatory to a new or existing deposit or loan account.

If, for any reason, you are unable to provide the information necessary to verify your identity, the account(s) may not be opened; or the account(s) may be blocked or closed, which may result in additional fees assessed to the account(s).

For example, Geolocation data collected from your mobile device when you ask for the location of the nearest ATM is personally identifiable when obtained through Mobile Banking.

Powerco Federal Credit Union does not store confidential or sensitive personal information in cookies. Our website uses cookies to enhance our members' Online Banking session by making navigation easier and providing important security features. For certain applications, such as Online Banking, cookies are a requirement because they help protect the privacy of a member's transactions by, for example, automatically terminating the online session if the member forgets to log out.

Cookies cannot be used to capture your email address, obtain data from your hard drive or gain confidential or sensitive information about you. Click Stream Auditing
Click Stream Auditing includes information such as a web surfer's IP address, web pages which have been viewed or acted upon by a web surfer, date and time, domain type, and when a web surfer has responded to an advertisement. We may occasionally combine this information with individual information on an aggregate level to determine the effectiveness of our advertising.

Action Tags and Other Technologies
Action Tags are commonly referred to as web beacons or GIF tags. This type of technology is inserted in various places within our website to collect anonymous information about your visits to the Powerco Federal Credit Union site and your interaction with our ads and content. We may use certain technologies to collect additional information related to the status and condition of your mobile devices. This information may be used to support the security of your transaction with Powerco Federal Credit Union, determine industry trends and for other research purposes.

Information Use
Personal information that we collect about you is used to provide you with optimal online experiences with us. We use it to help determine your financial interests and needs in order to recommend relevant products and services. We use personal information about you to qualify you for products and services that you request, to process your transactions, authenticate your identity, prevent fraud, and to keep your information and financial transactions secure.

Information Sharing
Powerco Federal Credit Union shares your personal information within its affiliates and with select third parties in accordance with the terms described in our privacy notice. The notice also provides a toll free number for you to limit certain sharing. Additional information is provided below under Advertising and Tracking and under Your Options. We may share personal information when required by law or a subpoena or court order. We may also share personal information when we suspect fraud or for risk management purposes.

The Credit Union will not provide, sell or share your personal information to any non-affiliated third party for independent use. We share member information only in the following circumstances: you authorize it; you have requested a transaction requiring it; we are reporting your information to a credit reporting agency; or we are required or permitted by law to disclose such information. Information is shared with affiliated organizations when involving products and/or services of value to members, which would otherwise not be available through the Credit Union. If a member desires such information not be made available to affiliated organizations, they are advised to contact Powerco Federal Credit Union to make their wishes known. Additionally, to preserve vital member information, employees of the Credit union sign confidentiality agreements at the time of hire to maintain the secrecy of proprietary information.

Children
In keeping with the Children’s Online Privacy Protection Act (COPPA), Powerco Federal Credit Union websites and mobile applications are not directed to children and do not knowingly collect information from children. We recognize that protecting children’s identities and privacy online is important and that the responsibility rests with both the online industry and parents.

Access
Powerco Federal Credit Union does not maintain a process which allows visitors to review and request changes to any of his or her personally identifiable information, including information that is collected through the use of cookies or other tracking devices, on the website or our online service. Retention and Destruction
The Credit Union retains personally identifiable information as long as necessary to provide the products and services for which the information was collected, to process and maintain a record of transactions, and as long as necessary for legal process or to satisfy government retention requirements. When the retention period expires, the Credit Union destroys data that was maintained in any form in a manner that renders it completely unusable and incapable of restoration

Geolocation Data
The Credit Union does not access location data stored on your mobile device without your permission. Some features, such as our location tool, which locates the nearest Powerco Federal Credit Union branch or ATM and shows the best route to get there, will not fully function unless you have enabled access to your location data.

Transmission of Sensitive Data
It may be necessary for the Credit Union to periodically transmit sensitive data to contracted vendors. The Credit Union will conduct annual audits of all e-commerce policy and procedures to ensure compliance with any Federal and/or State statutes, regulations and laws. This audit will include review with internal policy and procedure as well.
